    Recess appointments made sense when it took days (or even weeks) for the members of the Senate to get back and forth to their states necessitating longer recesses but that is no longer the case. There is really no reason for recess appointments anymore except to appoint a particularly unqualified or unpopular candidate.

    The GOP can't stand the fact that Obama has saved the country from dubya's malfeasance ...... oh by the way it would be remiss of me not to mention that Obama has succeeded despite the obstructionism and further malfeasance by the Congressional GOP during his Presidency .

    Obama has succeeded....

    .....in compiling the worst economic record in living memory..the worst recovery from a recession since the 1930s...

    ...in demagoging the rich and fueling the dangerous poison of class warfare, dividing  Americans against each other... 

    .... in spending wildly and recklessly and putting the deficit at dangerous levels..

    ......And most importantly, Obama has succeeded in doubling the number of food stamp recipients , giving away free Obama cell phones and overall making sure more and more Americans are dependent on government.

    ...except when one party fights an appointment not because of qualification issues, but because they want to hamstring an agency.

    ...the boilerplate, delivered.  E.g., "Look over there, not over here."  Next will be an equivalency (more acknowledgment) if someone bites down on any of the hooks?

    Returning to the topic...  The original originalist has staked out a position whose sole premise is that he said it first.  "I am the originalist."  No one else will reply with, "No, I'm the originalist!" because it would just sound silly, and then get sillier as the "discussion" retrogresses.  Because, as it retrogresses in the sunlight, the cleverness is exposed as just laziness.  But he's believed by those who believe that divine inspiration prevails, and in communicating directly with and channeling ghosts, and because he wears eccentric hats to make you wonder who or what inspires him.  Possibly also because he also channels another sitting justice.

    A palpable air of hypocrisy hangs over the Senate these days. Seeking to distract attention from President Obama’s unconstitutional “recess” appointments — not to mention the failure of his economic policies — Democrats disingenuously accuse Republicans of “obstructing” the president’s judicial nominees.

    In an attempt to create the perception of Republican resistance, Sen. Harry Reid (D-Nev), has taken the extraordinary step of scheduling contentious cloture votes for 17 nominees who were otherwise on the normal path to routine confirmation, claiming “delay for delay’s sake.”

    Of course, these desperate claims are entirely false: the Senate has already confirmed more of President Obama’s nominees (129) than it did during President George W. Bush’s entire second term (120), and has done so at an almost identical pace (average of 218 and 211 days, respectively, from nomination to confirmation). Indeed, not long ago Reid acknowledged that the Senate has “done a good job on nominations,” and a Judiciary Committee Democrat recently noted that we have been “speeding up the confirmation of judges.”

    Claims of Republican obstruction are not only demonstrably false, they are highly hypocritical. The very Democrats now seeking to manufacture confirmation controversy personally devised and carried out a systematic effort to block President Bush’s judicial nominees through an unprecedented use of the Senate filibuster.

    But, back to the recess appointments.  The article posted was very good. However, if Obama's view of what recess means is accurate, then the president needs to wait for the Senate to go to lunch, the bathroom, or home for the day, and then make any appointments he wants.

    Clearly the founders did not intend this,  they we referring to longer recess.
